Americans with Disabilities Act

The landmark American with Disabilities Act (ADA) enacted on July 26, 1990, provides comprehensive civil rights protection to individuals with disabilities in the area of employment, State and local government services, public accommodations, and telecommunications.

The ADA is a federal anti-discrimination statute designed to remove barriers which prevent qualified individuals with disabilities from enjoying the same opportunity that are available to persons without disabilities.

Title I Employment - Equal Employment Opportunity for Individuals with Disabilities
This establishes a process in which employers must assess a disabled person’s ability to perform the essential functions of the specific job held or desired.  Businesses must provide “reasonable accommodations” to protect the rights of individuals with disabilities in all aspects of employment.

Title II Public Services - Nondiscrimination on the Basis of Disability in State and Local Government Services
This protects qualified individuals with disabilities from discrimination on the basis of disability in the services, programs, or activities of all State and local governments.  As well as the requirements for making programs accessible to individuals with disabilities and for providing equally effective communication.

Title III Public Accommodations - Nondiscrimination on the Basis of Disability by Public Accommodations and in Commercial Facilities
This prohibits discrimination on the basis of disability by private entities in places of public accommodations.  Title III requires that all new places of public accommodation and commercial facilities be designed and constructed so as to be readily accessible to and usable by persons with disabilities.  In addition, public transportation systems, such as public transit buses and commuter rail systems, must be accessible to individuals with disabilities.

Title IV - Telecommunications
The ADA requires the establishment of telephone relay services for individuals who use telecommunications devices for people with hearing impairments (TTYs) or similar devices.
